How Colorado divides the house

Colorado is an equitable distribution state. The court divides marital property fairly, which is not always 50/50.

  • Marital vs. separate. A home bought during the marriage is presumed marital no matter whose name is on the deed. A home one spouse owned before the wedding is usually separate, but its increase in value during the marriage is marital.
  • What the judge weighs. Colorado Revised Statutes 14-10-113: each spouse's contribution (including as a homemaker), the value of what each keeps, each spouse's finances after the divorce, and whether the spouse with the kids should keep the home for a time.
  • Where Aurora cases are heard. Arapahoe County (18th Judicial District), Arapahoe County District Court, Arapahoe County Justice Center, 7325 S. Potomac St., Centennial 80112; Adams County addresses file in Adams County District Court, Adams County Justice Center. Arapahoe County divorce and the house has the courthouse, self-help center and hours.
  • Timing and cost. One spouse must have lived in Colorado 91 days before filing; the decree cannot be entered until 91 days after service. Filing fee $260, response $146.

Where do I file for divorce if I live in Aurora?

It depends on the county on your deed. Arapahoe County addresses file in Arapahoe County District Court, Arapahoe County Justice Center (7325 S. Potomac St., Centennial 80112); Adams County addresses file in Adams County District Court, Adams County Justice Center (1100 Judicial Center Dr., Brighton 80601). One spouse must have lived in Colorado for 91 days before filing. The petition fee is $260 and the response fee is $146 (since January 2025); a fee waiver is available on form JDF 205.

Who gets the house in a Colorado divorce?

Whoever the two of you agree on in the settlement, or whoever the judge awards it to after weighing the factors in C.R.S. 14-10-113. Most couples sell and split the equity because neither one can carry the whole payment alone.

Who gets to stay in the house during the divorce?

Whoever you agree on, or whoever the court orders. A temporary order can give one spouse exclusive use of the home while the case is open. It does not change who owns it.

Can we sell the house before the divorce is final?

Yes, and many couples do. Both spouses sign the listing and the contract, and the proceeds are held or split the way your written agreement or a court order says.

Is it better to sell before or after the divorce?

Selling before means both names come off the loan sooner and the proceeds are divided under the settlement. Selling after means the spouse awarded the home controls the sale. The capital gains exclusion can differ too, so ask a CPA.

How is the value of the house decided?

By agreement, by a licensed appraiser, or by the court if you cannot agree. We give both spouses the same written market analysis first so nobody is negotiating from a number the other has not seen.

Can one spouse refuse to sell?

Not forever. If the house is marital property the court can order it sold and appoint someone to sign if a spouse will not. Most cases settle before that. Divorce Decisions covers this in detail: what if one spouse refuses to sell.

Can I keep the house if my spouse was the main earner?

Only if you can refinance the loan in your own name or the settlement lets you stay on the existing loan for a set time. Maintenance and child support can count as income for a mortgage once they have a payment history. See our divorce for women page for the full answer.

What if we owe more than the house is worth?

Then there is no equity to divide. The options are keep it, wait, or sell short with the lender's approval. Read our underwater guide before you list.

How long does a Colorado divorce take?

The court cannot enter a decree until 91 days after the petition is served. Uncontested cases often finish in three to four months; contested cases with a house to fight over take longer.

Do we pay capital gains tax when we sell?

A married couple filing jointly can usually exclude up to $500,000 of gain on a primary home if they sell before the decree in that tax year; afterward each ex-spouse gets $250,000 if the ownership and use tests are met. Ask a CPA before you pick a closing date.

Does the listing say it is a divorce sale?

No. The listing says nothing about why you are selling. Both spouses get the same information at the same time, and calls come to one number.

What does a divorce realtor cost?

The same commission as any other sale, paid out of the proceeds at closing. There is no extra fee for handling a divorce. The consultation is free.
