What Kenna does on a probate listing that a standard listing skips

  1. Court-ready valuation. Two numbers on day one: the date-of-death value for the estate's tax basis, and today's market value. Both come in a written Smart Pricing Report with the active, pending and sold comps, so the personal representative has something to hand the attorney and the heirs.
  2. Two prices: as-is and prepared. An estate home sold as-is closes faster and sells for less. A cleaned, painted and staged one sells for more and takes 4 to 8 weeks longer. We put both numbers side by side with the cost of the work, and the estate chooses.
  3. The clean-out bench. Estate sale companies, donation pickups, junk haulers, locksmiths, lawn and snow crews, and a senior move manager when a parent is moving to care. One call, one invoice, paid at closing where the vendor allows it.
  4. Every heir gets the same information. A written update every week to everyone the personal representative names: showings, feedback, offers, next decision. Video walkthroughs and e-signature for the sibling in another state. Disagreements shrink when everyone sees the same numbers.
  5. The paperwork title needs. Letters, the death certificate, the court case number, and the personal representative's deed. We hand title the packet at listing, not at closing, so the file does not stall in week 12.
  6. Cash offer or open market, with both numbers. A cash offer on an estate home in Colorado runs 70% to 85% of market value and closes in 10 to 14 days. The open market takes 30 to 60 days longer and brings more money. We show both; most estates take the market, some take the speed.
  7. The house while it waits. Utilities on, heat at 55 in winter, weekly checks, mail forwarded, insurance switched to a vacant-home policy. An empty house for four months is the thing that goes wrong on estate sales.

Probate for a home in Colorado Springs and El Paso County runs through El Paso County District Court (probate division) for Colorado Springs, Monument, Fountain, Falcon and Peyton, and Teller County District Court for Woodland Park. Who signs, and what they need

  • The personal representative (executor) signs the listing, the contract and the deed once Letters are issued. Before Letters, nobody can bind the estate.
  • A trustee signs if the home is in a living trust, and probate is skipped for that home entirely.
  • Joint owners with a right of survivorship sell without probate; the surviving owner records the death certificate and sells as an individual.
  • A beneficiary-deed grantee takes title at death and sells as the owner.

The money questions

  • Taxes on the sale. Inherited homes get a stepped-up basis to the date-of-death value, so a home bought for $90,000 in 1985 and worth $600,000 at death sells with little or no capital gain. That is why the date-of-death value on day one matters.
  • What the estate pays. Nothing up front. Commission, clean-out and any prep the estate approved are paid from the proceeds at closing.
  • Medicaid estate recovery. If the owner received long-term-care Medicaid, Health First Colorado files a claim against the estate for what it paid. It is paid from the sale proceeds like any creditor; it does not stop the sale. Read selling a home to pay for assisted living.
  • The mortgage keeps running. Payments, taxes and insurance continue until closing. A reverse mortgage comes due at death with a 6-month window, extendable, and the estate keeps whatever the sale brings above the balance.
  • Siblings who disagree. One wants to keep it, two want to sell: the one who keeps it buys the others out at the appraised value, or the home sells and the proceeds split by the will. A written valuation from a neutral third party settles most of it.
