In Boulder County District Court, Boulder County Justice Center, 1777 6th St., Boulder 80302. One spouse must have lived in Colorado for 91 days before filing. The petition fee is $260 and the response fee is $146 (since January 2025); a fee waiver is available on form JDF 205.
Whoever the two of you agree on in the settlement, or whoever the judge awards it to after weighing the factors in C.R.S. 14-10-113. Most couples sell and split the equity because neither one can carry the whole payment alone.
Whoever you agree on, or whoever the court orders. A temporary order can give one spouse exclusive use of the home while the case is open. It does not change who owns it.
Yes, and many couples do. Both spouses sign the listing and the contract, and the proceeds are held or split the way your written agreement or a court order says.
Selling before means both names come off the loan sooner and the proceeds are divided under the settlement. Selling after means the spouse awarded the home controls the sale. The capital gains exclusion can differ too, so ask a CPA.
By agreement, by a licensed appraiser, or by the court if you cannot agree. We give both spouses the same written market analysis first so nobody is negotiating from a number the other has not seen.

Only if you can refinance the loan in your own name or the settlement lets you stay on the existing loan for a set time. Maintenance and child support can count as income for a mortgage once they have a payment history. See our divorce for women page for the full answer.

The court cannot enter a decree until 91 days after the petition is served. Uncontested cases often finish in three to four months; contested cases with a house to fight over take longer.
A married couple filing jointly can usually exclude up to $500,000 of gain on a primary home if they sell before the decree in that tax year; afterward each ex-spouse gets $250,000 if the ownership and use tests are met. Ask a CPA before you pick a closing date.
No. The listing says nothing about why you are selling. Both spouses get the same information at the same time, and calls come to one number.
