Marital vs. separate. Property acquired during the marriage is presumed marital. Property owned before the marriage, or received as a gift or inheritance, is separate, but the increase in its value during the marriage is marital.

Residency and timing. One spouse must have lived in Colorado 91 days before filing. The decree cannot be entered until 91 days after the other spouse is served.

Will my wife (or husband) get the house in the divorce?

Colorado does not favor either spouse. If you cannot agree, the judge divides marital property equitably using C.R.S. 14-10-113: contribution (including as a homemaker), what each spouse keeps, each spouse's finances afterward, and whether the parent with the kids should stay for a time.

Who gets to stay in the house during the divorce?

Whoever you agree on, or whoever a temporary order names. Staying does not change ownership. A protection order can also decide it.

How is the house divided?

Usually by selling and splitting the equity, or by one spouse buying the other out after a refinance. The court can also award the house to one spouse and offset with other assets.

Is it better to sell before or after the divorce?

Before: both names come off the loan sooner and the $500,000 joint capital-gains exclusion may still apply. After: the spouse awarded the house controls the sale. Ask a CPA about the tax year.

How is the value of the house determined?

By agreement, a licensed appraisal, or the court. We give both spouses the same written market analysis with the comparable sales so the conversation starts from one number.

Is Colorado a community property state?

No. Colorado is an equitable distribution state. Nine states (Arizona, California, Idaho, Louisiana, Nevada, New Mexico, Texas, Washington, Wisconsin) use community property; Colorado divides fairly, which is often but not always 50/50.

Should I keep or sell the house?

Keep it only if you can refinance alone and carry the payment, taxes, insurance and upkeep comfortably. Otherwise selling and splitting leaves both of you with a down payment and no shared debt.

Should I buy out my spouse's share?

Only with a pre-approval in hand and an appraisal both sides accept. A buyout that fails after the decree puts the house back on the market under worse terms.

What if one spouse refuses to sell?

The court can order the sale and appoint someone to sign for the refusing spouse. Most cases settle before it gets there.

Which professionals do I need?
