Douglas County left the 18th Judicial District and became part of the new 23rd Judicial District (Douglas, Elbert and Lincoln) in January 2025. Older articles that say 18th are out of date.

How the house gets divided in Douglas County

Colorado is an equitable distribution state. The court divides marital property fairly, not always equally, using the factors in C.R.S. 14-10-113. A home bought during the marriage is presumed marital regardless of whose name is on the deed.

  • Sell and split. The most common outcome. Both names come off the loan and each spouse leaves with cash.
  • Buyout. One spouse refinances alone and pays the other their share. It only works with a pre-approval.
  • Delayed sale. One spouse stays for a set time, often until the end of the year, with a firm list date in the decree.

How long does it take?

One spouse must have lived in Colorado 91 days before filing, and the decree cannot be entered until 91 days after the other spouse is served. Mandatory financial disclosures are due within 42 days. Most contested cases take longer than the minimum.

Do we have to go to mediation?

Colorado courts may refer any case to mediation, and most districts, including the 23rd Judicial District, commonly require it before a contested permanent-orders hearing. The exception is a case involving abuse where a party objects.

Is there a parenting class?

If you have children under 18, most districts require a parenting-after-divorce class and a certificate filed with the court. The parents pay for it based on ability to pay.

How does the Douglas County court divide the house?

The same way every Colorado court does: equitably, under C.R.S. 14-10-113. The judge weighs each spouse's contribution, what each keeps, each spouse's finances afterward, and whether the parent with the kids should stay for a time. Most couples settle by selling and splitting the equity.

Can the court order the house sold?

Yes. If you cannot agree, the court can order the sale and can appoint someone to sign for a spouse who refuses. A neutral divorce realtor is often written into that order.

Do I need a lawyer?

Not legally, and many uncontested cases use the court's JDF forms with self-help support. If there is a house with equity, a pension, or kids, at least a consultation with an attorney is worth the cost. We can recommend divorce attorneys who work in this county.
